Competition Terms and Conditions:
1. The Promoter of this giveaway is @EmilyCanham.
2. Eligibility: Information on how to enter the Giveaway (the “Promotion”) and the prize form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions, and any terms and conditions that are supplied with any Prize.
3. These Terms and Conditions will apply to anyone that enters the Promotion whether they are a UK legal resident who enters the Promotion via Instagram (@EmilyCanham), or not. Entrants must be at least eighteen (18) years old at the time of entry or have parent’s permission. Employees (and their immediate families) and agents or suppliers of the Promoter and agencies associated with this Promotion are ineligible to enter.
4. Timing: The Promotion commences from the moment that that @EmilyCanham announces the Promotion on Instagram @EmilyCanham (the “Giveaway Post”), which will be at 12:00 GMT 6th December 2020 and will end at 23.59 PM GMT on 20th December 2020 (the “Promotion Period”). The Promoter’s computer is the official time‐keeping device for the Promotion.
5. How to Enter: Entrants must have an Instagram account and must set the “Private Account” option in account privacy settings on their Instagram account to “OFF”. Entrants must also timely check their Instagram account for any Promoter direct messages or @Replies.
6. Entrants must, during the Promotional Period: (i) tag one friend in the comment section of the Giveaway Post; (ii) share the Giveaway Post on their Instagram story, tagging @EmilyCanham; (iii) follow Emily Canham’s Instagram account (@EmilyCanham); (iv) like and save the post; (v) subscribe to Emily’s YouTube Channel (www.youtube.com/emilycanham); (vi) subscribe to Emily Canham’s vlog channel (www.youtube.com/emilycanhamvlogs); at least until winner selection. Completing the steps contained in this Clause 7 will count as one (1) entry into the Promotion (“Entry” or “Entries”).
7. There is a limit of one (1) Entry per person during the Promotional Period.
8. The Promoter reserves the right at its sole discretion to disqualify any Entry at any time in the event it is determined that the Entry is offensive or inappropriate, or if it is determined that the entrant has not otherwise complied with these Terms and Conditions. Each Entry must be in a format compatible with Instagram and must be made in accordance with Instagram’s own terms and conditions.
9. Winner Selection: On or about 20.00 GMT on 20th December 2020, the Promoter will procure that one (1) winner (“Winner”) is randomly selected from all eligible Entries received (“Winner Selection”). The Winner will receive ALL of the prizes referred to in Clause 11 below. The Winner will be notified by direct message on the Instagram account used to enter the Promotion (“Winner Notification”).
10. The Promoter reserves the right to revoke the prize if not accepted by the Winner providing their address and contact phone number, within 24 hours in which case the draw will be run again in the same manner.
11. Prizes: The Winner will receive all of the prizes specified in the Giveaway Post, subject to Clause 13 below. The approximate total retail value of the prizes together is c.£8,647.38 – and shall include all of the items listed in the Annex
12. Where applicable, the prizes will be provided to the Winner at the address provided in response to Winner Notification by recorded mail within fourteen (14) days after acceptance by the Winner either by postal service or email. Tracking number or email confirmation will be supplied and if the tracking states that a prize was delivered then we will consider that prize duly awarded.
13. Each prize is not transferable or exchangeable. Prizes may vary from those shown in the Giveaway Post on the @EmilyCanham Instagram account. Issues with a prizes quality or operation should be taken up with the manufacturer of the Prize and not Emily Canham.
14. Publicity: The Winner may be featured on the Promoter’s Facebook, Instagram and Twitter pages. Acceptance of the prize will constitute permission for the Promoter to use the name and social media handles of the Winner without any further compensation, unless prohibited by law.
15. General Conditions: If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, The Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
16. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer rights as described within the Consumer Rights Act, as well as any other consumer protection laws in the UK (“Non‐Excludable Consumer Rights”).
17. Liability: Except for any liability that cannot by law be excluded, including the Non‐Excludable Consumer Rights, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Promotion, including but not limited to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
18. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. Instagram bears no liability with regards to those taking part in this Promotion and the Promoter indemnifies Instagram against any loss or claim made as a result of this Promotion. All of the relevant terms and conditions of Instagram apply to any and all Entries.
19. These terms and any disputes arising as a result of them shall be governed exclusively by the laws of England and Wales whose Courts shall have exclusive jurisdiction.
